Rules for using the Health Insight application and services

Agreement to these terms

These Terms of Service are a legal agreement between you and Atilasllc for your use of the Health Insight mobile application, website, application programming interfaces, and related services. By creating an account, accessing the service, or purchasing an analysis credit, you agree to these terms and the Health Insight Privacy Policy. If you do not agree, do not use the service.

Health Insight is currently offered only in the United States. You must be legally able to enter this agreement. The service is not directed to children under 13. A parent or legal guardian must provide any authorization required by applicable law for a minor.

Purpose and medical limitations

Health Insight is a lifestyle-improvement and educational wellness tool. It organizes laboratory information you provide, shows changes over time, and offers educational lifestyle guidance. The service does not provide medical advice, diagnosis, treatment, emergency care, or a clinician-patient relationship. Health scores and Analysis Engine summaries are informational estimates and may be incomplete or wrong.

Do not delay or disregard professional medical advice because of information in Health Insight.

Contact a qualified healthcare professional about abnormal results, symptoms, medications, diagnoses, or treatment decisions.

Call 911 or the appropriate emergency service if you may be experiencing a medical emergency.

Accounts and authentication

You must provide accurate account information and protect your credentials and device. You are responsible for activity performed through your account unless caused by our failure to use reasonable safeguards. Tell us promptly if you suspect unauthorized access. Apple and Google sign-in are governed in part by those providers' terms. Creating a Health Insight account does not create or change an Apple or Google account.

The Sign In screen authenticates an existing Health Insight account. A new account must be created through the Create Account flow, including when Apple or Google is used. We may require verification, revoke sessions, or restrict access when reasonably necessary to protect users or the service.

Uploaded information and permissions

You keep ownership of laboratory reports, profile information, and other content you submit. You give Atilasllc a limited, nonexclusive permission to host, copy, scan, extract, transform, and otherwise process that content only as needed to provide, secure, maintain, and improve the service, comply with law, and enforce these terms. The Privacy Policy explains the providers and processing involved.

You represent that you have the right to upload the information and that it concerns you or that you have valid authority to use it. Do not upload another person's report without permission. Files are subject to type, size, integrity, and malware checks. We may reject, quarantine, or delete a file that is unsafe, unsupported, deceptive, unlawful, or cannot complete the required security scan.

Analysis charges and credits

The first successfully completed analysis for each Health Insight account is free. The free analysis is recorded at the account level and is not restored when its uploaded report or derived report is deleted. After the free analysis, each additional analysis requires one analysis credit. The United States price is currently $5.99, but the App Store price shown before purchase controls if it differs.

Apple processes in-app purchases. Health Insight does not receive your payment-card information.

A purchased analysis credit does not expire and remains on the Health Insight account until used for a successfully completed analysis.

Canceling a purchase, a pending transaction, failed verification, a rejected security scan, or a failed analysis should not consume a credit.

Deleting a completed paid analysis does not return the used credit.

Refund requests and purchase disputes are handled under Apple's applicable App Store policies. Nothing in these terms limits rights that cannot lawfully be waived.

You must not manipulate accounts, transactions, files, devices, or provider credentials to obtain an additional free analysis or duplicate credit. We may correct a credit balance after investigating a verified transaction or processing error.

Acceptable use

You may not:

Use the service unlawfully, fraudulently, or to violate another person's privacy or intellectual-property rights.

Upload malware, corrupted content, deceptive files, or content you are not authorized to process.

Probe, bypass, disable, or interfere with authentication, authorization, rate limits, file scanning, billing, or other security controls.

Reverse engineer or copy the service except where applicable law expressly permits it.

Use automated means that place an unreasonable load on the service or attempt to extract another user's information.

Service availability and changes

We may maintain, update, suspend, or change the service. Processing depends on network access and third-party services, including Apple, Google, Amazon Web Services, and Analysis Engine processing providers. We do not promise uninterrupted or error-free availability. If a temporary failure prevents analysis, the uploaded file or credit will be handled as described in the App and these terms.

Account deletion and termination

You may delete your account in My Profile. Account deletion permanently removes account-linked active-system data and cannot be reversed. The Privacy Policy explains backup expiration and the limited retention of pseudonymous account-deletion audit records and purchase records. Deleting the Health Insight account does not delete an Apple or Google account.

We may suspend or terminate access when you materially violate these terms, create a security or legal risk, misuse purchases or the free analysis, or when required by law. When practical, we will provide notice and a reasonable opportunity to correct the issue. Sections that by their nature should survive termination, including payment records, ownership, disclaimers, liability limits, dispute terms, and lawful retention, continue to apply.

Intellectual property

Atilasllc and its licensors own the Health Insight software, interface, branding, documentation, and service-generated structure, excluding your uploaded content. Subject to these terms, Atilasllc grants you a personal, limited, revocable, nontransferable license to use the App on Apple-branded products you own or control as permitted by the App Store usage rules. No other rights are granted.

Third party services

Links, sign-in services, health-data frameworks, payment processing, email, cloud infrastructure, and cited educational sources may be provided by third parties. Their terms and privacy practices apply to their services. Atilasllc is responsible for Health Insight, not for a third party's independent service or content. Apple is not responsible for maintaining or supporting Health Insight and is not a party to these terms. Apple and its subsidiaries are intended third-party beneficiaries of the provisions applicable to the App and may enforce them.

Disclaimers

To the maximum extent permitted by law, Health Insight is provided as available and without warranties of merchantability, fitness for a particular purpose, accuracy, noninfringement, or uninterrupted operation. We do not warrant that a report upload, extracted value, health score, trend, source, or lifestyle suggestion is complete or correct. Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.

Limitation of liability

To the maximum extent permitted by law, Atilasllc and its officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or opportunities arising from the service. Our total liability for all claims relating to the service will not exceed the greater of the amount you paid for Health Insight during the 12 months before the event giving rise to the claim or 100 United States dollars. This limitation does not apply where liability cannot lawfully be limited, including liability for intentional misconduct or another nonwaivable right.

Governing law and disputes

These terms are governed by Delaware law, without regard to conflict-of-law principles, except to the extent federal law or a mandatory consumer law applies. Before filing a claim, you and Atilasllc agree to attempt in good faith to resolve it by written notice. Unless applicable law permits another location, a claim that is not resolved will be brought in a state or federal court with jurisdiction in Delaware. These terms do not require arbitration and do not waive a right that applicable law does not permit you to waive.

Changes to these terms

We may update these terms when the service, pricing, providers, or legal requirements change. We will post the revised terms with a new Last updated date and provide additional notice or request agreement when required for a material change. Continued use after the effective date of a properly disclosed update means you accept the revised terms.
